Federal Court Orders Release of Kilmar Abrego Garcia from ICE Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face human smuggling charges, he was held in immigration custody.
In her decision, the court pointed out that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

The court proceedings center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in Tennessee.

The judge, who was hearing his challenge to removal in a Maryland district court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
